Terms for the one-time £650 remote baseline programme

Purpose
These Terms explain exactly what the Client is buying, how the programme is delivered, the equipment included, cancellation rights and the responsibilities of both parties. The Client should save a copy before paying.

1 Contract and acceptance
These Terms form the contract between Bodywise Training Ltd, referred to as Bodywise, and the person buying the programme, referred to as the Client. The contract is made when the Client selects the required terms checkbox on the Stripe checkout page and submits the £650 payment, and Bodywise accepts the order.
The checkout record, payment confirmation and the version number shown above provide the record of acceptance. No handwritten signature or Bodywise countersignature is required. Any change to these Terms must be agreed in writing.
2 Programme structure

The schedule may move where delivery, illness, travel, technical failure or incomplete data would make the baseline unsafe or unrepresentative. Bodywise will explain the reason and agree a revised start, pause or extension with the Client.
3 What the price includes
Equipment supplied for the Client to keep
- WHOOP 5.0 device with a 12-month WHOOP One membership.
- Omron M3 Comfort AFib blood pressure monitor.
- Body-measurement tape.
Delivery to one verified UK address is included. The Client normally keeps the equipment after programme completion. Any WHOOP renewal after the included 12 months is not included and remains the Client's choice and responsibility.
Professional service and deliverables
- Trainerize onboarding, health-data consent, a PAR-Q and the Prime State initial assessment.
- Setup and familiarisation support before the official capture begins.
- Fourteen days of WHOOP baseline data with continuous wear except when charging or where use is unsuitable.
- A 3-day food record and 7 days of blood pressure readings.
- Agreed movement, strength, cardiovascular and body-composition measures where safe and suitable for remote delivery.
- Review of sleep, HRV, recovery, strain or load, blood pressure, nutrition and assessment data.
- A personalised findings report, a 90-minute findings call and a 30-day action plan.
Scope
The £650 does not include ongoing personal training, medical diagnosis or treatment, or a 12-week coaching programme. Any continuation programme or credit is a separate written offer. Bodywise will not prescribe a training or nutrition plan before the baseline review unless separately agreed for safety or setup.

The allocation is used only where a lawful cancellation or refund requires the package to be separated. It does not reduce the Client's statutory rights.
4 Delivery and third-party services
Bodywise will confirm dispatch or any stock delay. Unless another date is agreed, goods will be delivered within 30 days after the contract is made. The Client must check the delivery promptly and tell Bodywise about missing, damaged or faulty items.
Ownership and risk pass to the Client on delivery, subject to statutory cancellation, return and faulty-goods rights. The Client must follow manufacturer instructions, use the correct cuff and fitting, keep devices charged and secure, and stop using damaged equipment. Manufacturer warranties and statutory rights continue to apply.
Trainerize, Stripe, WHOOP, Omron and other necessary providers have their own terms and privacy notices. Bodywise is not responsible for an independent provider's outage or service change, but will take reasonable steps to offer a suitable workaround where it materially affects delivery.
5 Client responsibilities
- Provide complete and accurate health, medication, injury, pregnancy and medical-advice information and update Bodywise if anything changes.
- Complete the separate health-data consent, PAR-Q, Prime State assessment and requested records honestly and on time.
- Wear WHOOP consistently, follow the agreed blood pressure method and maintain normal routines unless safety requires otherwise.
- Use a safe, private area for remote tests, position the camera as requested and stop if the environment, equipment or movement is unsafe.
- Tell Bodywise promptly about illness, travel, unusual stress, missed data, device problems or another disruption that could distort the baseline.
- Attend the findings call or rearrange it with reasonable notice and review the report and action plan.
6 Health and safety
Prime State is a fitness and performance coaching service. It is not medical care and does not diagnose, monitor or treat disease. Wearable, blood pressure and body-composition readings are informational and do not replace advice from a doctor or another regulated clinician.
Bodywise may request medical clearance or alter, postpone or stop an assessment where information or symptoms raise a safety concern. The Client must stop immediately and tell Bodywise if they experience pain, dizziness, faintness, unusual shortness of breath, chest discomfort, palpitations or another concerning symptom. Urgent or severe symptoms require emergency medical help rather than waiting for Bodywise.
Remote delivery means Bodywise is not physically present to control the environment or provide hands-on assistance. The Client remains responsible for following instructions within their ability and not attempting a test they consider unsafe.
7 Personal data and privacy
Bodywise is the controller for information it collects for the programme. It uses ordinary personal data to administer the order, deliver equipment and services, communicate, keep business records and protect legal rights. The privacy notice is available at https://www.bodywisetraining.com/privacy-policy and privacy questions may be sent to info@bodywisetraining.com.
Health information is special category data. Stripe checkout acceptance does not provide consent to process health data. Before the Client completes a PAR-Q, assessment or health record, Bodywise will request a separate, explicit health-data consent in clear terms. The Client may refuse or later withdraw that consent, although Bodywise may then be unable to start or complete a measurement-led baseline.
Bodywise will not ask the Client to enter health information in Stripe. Relevant data may be handled by Trainerize and necessary email, document or cloud providers for programme delivery. WHOOP processes information through the Client's WHOOP account under its own privacy terms. Bodywise will restrict access and retain information only for as long as reasonably needed for delivery, safe follow-up, business records, complaints, insurance, legal claims and applicable obligations.
8 Measurement quality and results
Exercise and physical testing carry inherent risks. Bodywise will use reasonable care and skill, review the information supplied and adapt the service where appropriate, but cannot remove every risk.
Consumer devices and self-reported information can be incomplete or inaccurate. Fit, charging, cuff position, timing, behaviour, illness, alcohol, travel and technical errors may affect results. Bodywise's conclusions are limited by the quality and completeness of the information received.
The programme is intended to provide a useful baseline and practical priorities. No particular outcome is guaranteed. The Client remains responsible for decisions and actions after the programme, including seeking clinical advice where appropriate.
9 Communication and programme changes
Bodywise will use the contact details supplied at checkout and Trainerize messages for service communications. The Client should keep those details current and enable app notifications. A change that materially reduces the agreed service will require the Client's agreement or an appropriate remedy.
10 Cancellation and cooling-off rights
Service cancellation period
For a distance contract, the Client normally has 14 days beginning the day after the contract is made to cancel the service without giving a reason. Bodywise will not begin chargeable professional services during that period unless the Client separately makes an express request to start early.
If the Client expressly asks Bodywise to begin services during the cancellation period and later cancels, Bodywise may charge a proportionate amount for service supplied up to cancellation. The service cancellation right may end after full performance only where the legal requirements, including the Client's express request and acknowledgement, have been met.
Goods cancellation period
For the equipment, the Client normally has 14 days beginning the day after the goods are received to tell Bodywise they wish to cancel. After notifying Bodywise, the Client must return the goods within the applicable legal time limit and take reasonable care of them. Unless the goods are faulty or Bodywise agrees otherwise, the Client pays the direct return cost. Bodywise may make a lawful deduction for diminished value caused by handling beyond what is reasonably needed to inspect the goods.
Dispatch, device registration or membership activation does not remove statutory rights except where the law permits and all required information, express consent and acknowledgement have been obtained. Nothing in these Terms restricts rights relating to faulty, misdescribed or late goods or services not supplied with reasonable care and skill.
Refund calculation
Where a refund must separate the package, Bodywise will use the allocation in section 3, retain only amounts the law permits and explain the calculation in writing. Outside a statutory cancellation right, Bodywise may retain the reasonable value of professional work already delivered and equipment or membership costs already supplied or irreversibly committed, subject to the Client's legal rights.
How to cancel
Email info@bodywisetraining.com or write to Bodywise Training Ltd, 7 Braemar Road, Brentford, England, TW8 0NR. Suggested wording: I give notice that I cancel my Prime State Baseline contract. Include your name, address, order date and, where relevant, the date the goods were received.
11 Liability and legal rights
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability or consumer right that cannot lawfully be excluded. Subject to that, Bodywise is responsible for loss that is a foreseeable result of its breach or failure to use reasonable care and skill, but not for loss caused by inaccurate or withheld information, failure to follow safety instructions, or an independent third party outside Bodywise's reasonable control.
12 Ending the programme
Bodywise may pause or end the programme where continuing would be unsafe, unlawful or impossible, or where the Client seriously or repeatedly fails to provide required information, follow safety directions or engage with delivery. Bodywise will explain the decision and calculate any refund fairly. If Bodywise cannot deliver for reasons within its control, it will offer a reasonable reschedule or refund the undelivered portion.
13 Complaints and disputes
The Client should first contact info@bodywisetraining.com so Bodywise can investigate and respond. The law of England and Wales applies, and the courts with jurisdiction under consumer law may hear any dispute. The Client's statutory rights are unaffected.
14 Checkout record
By selecting the required terms checkbox and submitting payment through the Prime State Stripe Payment Link, the Client confirms that they had access to these Terms before ordering, could save or print them, and agree to version PSB-TC-2026-09-17-v1. Bodywise will provide or confirm access to a durable copy after payment.
15 Model cancellation form
Complete and return this form only if you wish to cancel. Email it to info@bodywisetraining.com or post it to Bodywise Training Ltd, 7 Braemar Road, Brentford, England, TW8 0NR.
I give notice that I cancel my contract for the Prime State Executive Performance Baseline and the goods and services included in that contract.
